Third party candidates must achieve 15 percent support across five national polls to be included in debates sanctioned by the Commission on Presidential Debates. Two weeks ago Johnson filed suit in federal court against the commission, and has launched a "waste your vote on me" campaign.

Stein and her running mate, Cheri Honkala were arrested outside of the final Presidential debate at Hofstra University, following a brief protest outside the venue of their exclusion.
